Is marijuana legal in Texas? Delta-8? THC? CBD?

Now, about the laws: In Texas and federal law, recreational use of marijuana is still illegal. The consequences vary for marijuana possession, depending on how much a person is carrying. The Texas Health and Safety Code states that possession of marijuana two ounces or less is considered a Class B misdemeanor.

Current Texas law allows the sale of consumable hemp products with up to 0.3% THC concentration.

Senate Bill 3, led by Texas Lieutenant Governor Dan Patrick seeks to ban the sale of all products containing any amount of THC, including Delta-8 and Delta-9 derived from hemp. The bill is under consideration in the House. The Texas House is also considering a different strategy than the Senate’s outright ban. House Bill 28 proposes a ban on all THC products intended for smoking and eating, (flower, edibles and vapes) but would regulate hemp-infused drinks.

The Texas Compassionate Use Program allows for the prescription of low-THC cannabis (defined as containing no more than 0.5% Delta-9 THC by weight) for a limited list of medical conditions, including epilepsy, multiple sclerosis, autism, cancer, and PTSD. Non-intoxicating cannabinoid products (CBD) are generally legal in Texas.
